General Conditions of Sale and Use

These general conditions of sale apply to the contract concluded between the company MITA FDG, a simplified joint-stock company with a capital of €1,111 registered in the Paris Trade and Companies Register under the SIREN number 838865558 and whose head office is located at 231 Rue Saint-Honoré, 75001 Paris, that manufactures and sells leather goods and travel items, and occasionally, jewelry, clothing, perfumes and other miscellaneous products under the brand “ALIS MITA” (hereinafter referred to as “MITA FDG”, “ALIS MITA”, “the Company”)

and

Any natural person of full age, non-commercial, acting exclusively within the framework of his personal needs having the legal capacity to contract (hereinafter referred to as “the Customer”, “the User”) who consults and / or makes a purchase of products on the https://alismita.com website (hereinafter referred to as the “Website”).

The purpose of these general conditions is to define the rights and obligations of the parties within the framework of the online sale of products offered by MITA FDG under the brand “ALIS MITA”, from the https://alismita.com website. The main language used in these conditions is French, which will prevail in the event of an unsuitable translation and before any judicial body. The Customer and/or User declares to have read these general conditions of sale and to have accepted them before using the website and/or placing any order. In this regard, these general conditions of sale are enforceable against it in accordance with the terms of Article 1119 of the Civil Code. Thus, in the event of a discrepancy between the general conditions invoked by either party, the incompatible clauses have no effect. In the event of a discrepancy between general conditions and special conditions, the latter prevail over the former.

The Agreement (as defined below) must be read carefully before using the Website and/or placing any order for ALIS MITA products to the extent that this Agreement affects the rights and obligations of the User.

The Customer and/or User acknowledges having communicated, prior to using the Website and/or placing his order and concluding the contract, in a readable and understandable manner, of these general conditions of sale and have accepted them by checking the box provided for this purpose before the implementation and validation of the ordering procedure on the Website. The same applies to the general conditions of use of the Website.

MITA FDG reserves the right to modify these general conditions of sale at any time. They will be applicable as soon as they are put online. The version applicable to the Customer’s order is that in force on the Website on the date the order is placed. For these reasons, MITA FDG advises the Customer to print and keep their own copy of the general conditions of sale when ordering.

3.1 Product details

The products governed by these general conditions of sale are those which appear on the https://alismita.com website and which are indicated as sold and shipped by MITA FDG under the brand “ALIS MITA”.

The products are offered on the Website within the limits of available stocks. They are described and presented with the greatest possible precision in order to provide the User and/or the Customer with the necessary information to enable him to know the product before placing the order. Each product is accompanied by photographs and a descriptive sheet including: the main materials used in its manufacture, the price, the dimensions, the colors available as well as any special characteristics.

3.2 Responsibility for photographs and drawings

The photographs and/or drawings of the products are presented for illustrative purposes only. Minimal differences between a product and its photograph may exist. Thus, some details may appear larger or smaller depending on the angle of view of the photograph. Likewise, certain colors or renderings (mat, gloss, satin, etc.) may be different depending on the calibration of the User’s screen. In case of doubt, if the User wishes additional information, he should contact Customer Service at the e-mail address bonjour@alismita.com.

3.3 Product manufacturing

As the manufacture of ALIS MITA products is artisanal, it is possible that certain measurements indicated on the product description sheets may differ slightly from the actual product that the Customer will receive. The dimensions displayed for the bags can thus vary by a maximum of 0.5 cm – in terms of length, height or width – compared to the dimensions indicated according to the texture of the material used for the creation of the product or the leatherwork techniques – upholstery used in particular for finishing the edges.

MITA FDG exclusively uses full grain leathers that reveal the natural characteristics of each skin. Thus, the veins, wrinkles and pores will not be considered as imperfections or defects but as characteristics which give the leather, and implicitly the product, its unique and natural character allowing it to evolve and age well with the time.

As the leathers we use are sometimes tanned in different baths, any variation in color of a tone from the selection on the day of purchase will be considered compliant. Likewise, any color of the metal parts which varies in tone will be considered compliant.

3.4 Compliance with the current European standards

MITA FDG undertakes to deliver products that meet the requirements in force relating to the safety and health of persons in accordance with European provisions, and in particular the legislation on regulated chemicals.

3.5 Compliance of CITES regulated products

Products with exotic leathers in their composition – among which MITA FDG uses in particular the crocodile, alligator, caiman, python, lizard, ostrich – are subject to the Convention on International Trade in Endangered Species of Wild Fauna and Flora, known as CITES, or the Washington Convention which aims to ensure that international trade in species listed in its appendices, as well as parts and derivatives thereof, does not harm the conservation of biodiversity and is based on the sustainable use of wild species.

As some exotic leathers are prohibited in certain countries and/or states, MITA FDG reserves the right to decline any validation of the order and delivery of a product made from exotic leather prohibited in the country and/or state of the Customer’s delivery address.

Products subject to CITES will be subject to special delivery and return conditions, the details of which will be described in Articles 7.3 and 8.3.

4.1 Application of prices and taxes in force

The prices indicated on the Website are expressed in euros or in US dollars and are understood to include all taxes (T.T.C.) in the sense that they take into account the VAT applicable on French territory on the day of the order. The price of the products includes delivery and return costs. The total amount due for each product is mentioned in the order summary. However, the prices displayed when placing the order do not include any customs duties and taxes other than value added tax which will be in addition to the sale price and exclusively payable by the Customer.

Payment of the full price can be made during the validation of the order in one go or divided into three thirds according to the schedule and the terms mentioned in article 5.4. At no time can the sums paid be considered as a deposit or down payment and the Customer undertakes to pay the full amount including VAT.

4.2 Price modification

MITA FDG reserves the right to change prices at any time but undertakes to apply the current prices indicated at the time of the order, subject to product availability on that date. Any change in the applicable rate of VAT will automatically be reflected in the price of products in the online store. If one or more taxes or contributions, were to be created or modified, up or down, this change may be reflected in the selling price of the products.

4.3 Price display errors

The Customer is informed that in the event of an incorrect, clearly derisory price being displayed, for whatever reason (manual error, technical error, computer bug), any order – including those that have been validated by MITA FDG – will subsequently be canceled. The Customer will be informed and will be able to place a new order at the corrected price.

5.1 Prerequisites

The Customer guarantees to MITA FDG that he has the necessary authorizations to use the payment method chosen by him, when validating the order form.

MITA FDG reserves the right to suspend any order management and any delivery in the event of non-payment or refusal of authorization of payment by credit card by officially accredited organizations. MITA FDG reserves the right in particular to refuse to make a delivery or to honor an order from a buyer who has not fully or partially paid a previous order or with whom a payment dispute is being administered.

5.2 Securing payments

The Customer is informed that MITA FDG uses 3D Secure 2 (3DS2) or Verified by Visa security devices depending on the Customer’s card. The latter is invited to request access to these services from his bank.

5.3 Currency of payment

All orders are payable in euros or US dollars.

5.4 Payment methods

The payment made by the Customer will only be considered final after actual receipt of the total amount due by MITA FDG. Payment is made exclusively by credit card in several ways:

  1. by bank card in full payment (Visa, Mastercard, Maestro): the amount of the order is debited at once for a maximum period of 7 (seven) working days;
  2. by PayPal;
  3. by PayPal in payment “4 times”: the amount of the order will be divided into four payments debited over a period of 3 months. The Customer can consult and manage the deadlines from his PayPal application. This payment offer is a financing offer taken out by the Customer and subject to PayPal’s acceptance and reimbursement conditions;
  4. by Apple Pay

5.5 Invoice

The date of registration of the order corresponds to the date of the online payment or of the first online payment if the latter occurs in several installments. An invoice is issued upon delivery of the order, available in the online Customer area or on request from Customer Service at the email address bonjour@alismita.com.

6.1 Placing an order on the Website

MITA FDG will acknowledge receipt of an order if and only if the steps mentioned below are fulfilled.

Step 1

The Customer selects the desired products and adds them to his basket. For some products, there is the possibility of personalizing the chosen product by adding the initials and/or another message.

Step 2

Once the chosen product (s) have been added to the basket, the Customer must check his basket by clicking on the “Basket” tab. If he has a “Privilege Code”, he must mention it in the box provided for this purpose. The total amount including the value added tax (VAT) of the order is then indicated in the summary.

Step 3

In order to validate his order, the Customer must validate his basket by clicking on “Order”.

Step 4

If the Customer has already placed an order on the Website, he has a Customer account and will identify himself only with his email address and password.

If the Customer places an order for the first time, he must enter all the data required for delivery and invoicing, namely:

  • the name and the first name;
  • contact details (phone and email);
  • the precise and detailed billing and delivery address;

Unless otherwise specified by the Customer, the billing address will automatically be the same as the delivery address. PO boxes are not accepted for deliveries.

  • the desired payment method.

Step 5

In order to validate the order, the Customer must:

  1. read and accept the General Conditions of Sale by clicking on “the General Conditions of Sale”, then by checking the box provided for this purpose;
  2. check the order summary and correct any errors;
  3. click on “Confirm my order” to confirm the order.

Step 6

After validation of the order, the Customer will access the secure payment screen. Payment is made online by credit card, PayPal or Apple Pay only. The customer must enter his bank card number, its validity date as well as the 3 numbers of the visual cryptogram on the back of his/her card. The request for authorization to debit the card is made at the time of validation of the order on the Website, except in the event of unavailability of the servers. If payment is accepted, the customer will be redirected to an order confirmation screen on the Website. If the payment is refused, the Customer must contact the Customer Service who will seek the reason for the refusal and will be able to offer him a solution to finalize his order.

6.2 Receipt of the order

Upon acceptance of payment, the Customer will receive an order confirmation email summarizing all the items ordered, the billing and delivery address as well as the estimated delivery date. The validation of the order by the Customer and the order confirmation sent to the Customer by e-mail by MITA FDG following the acceptance of payment constitute the conclusion of a sales contract between the parties and acceptance of the general conditions of sale.

6.3 Modification or cancellation of the order by MITA FDG

The products indicated on the Website are valid while stocks last. If certain products ordered were no longer available, MITA FDG will inform the Customer by e-mail of this unavailability and give him the option of canceling his order.

In case of unavailability of products likely to be the object of a restocking, MITA FDG will inform the Customer by e-mail of the additional delays of arrival of the products and will give her/him the possibility of proceeding to the cancellation of her/ his order if the Customer considers the delays are too long.

In case of failure of one of its suppliers as well as in case of force majeure, MITA FDG reserves the right to cancel all or part of an order. MITA FDG undertakes to notify the Customer by e-mail and to reimburse the sums received for the order or the part of the order canceled without delay and at the latest within 14 (fourteen) days of payment.

MITA FDG also reserves the right to not validate or cancel an order if it considers it to be in one of the situations mentioned below:

  • abnormal or abusive complaints on the part of the Customer;
  • abnormal orders regarding the quantities ordered;
  • previous abnormal or abusive exchanges and returns;
  • existing dispute with the Customer;
  • order placed for a purpose other than to satisfy a personal need;
  • possible risk of insolvency of the Customer;
  • suspected fraud.

6.4 Proof of the transaction

The computerized registers, kept in the computer systems of MITA FDG under compliant security conditions, will be considered as proof of communications, orders and payments between the parties. The archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as evidence for a minimum period of 10 years.

7.1 Terms of delivery

Delivery is made only after confirmation of payment by the MITA FDG bank. The products are thus delivered to the address indicated by the Customer on the order form. The Customer will have to ensure its accuracy. MITA FDG will send the Customer an email to confirm the shipment of their order and inform them of the package tracking number so that they can track the delivery on the carrier’s Website.

MITA FDG does not accept deliveries to a PO Box and reserves the right to cancel any order found in such a situation. The products will be delivered to the Customer or to the third party whose name is mentioned in the order against signature only.

7.2 Delivery times

Orders are shipped by our Customer Service within a maximum of 7 (seven) working days from receipt of payment by our banking organization and validation of the order by our Customer Service. Except in cases of force majeure, the delivery times of our carriers are as follows:

  • 1 to 2 working days for deliveries to mainland France
  • 2 to 4 working days for deliveries to the European Union
  • 3 to 7 working days for deliveries to the rest of the world

Some countries may be subject to a delivery time greater than the times indicated above. MITA FDG will inform the Customer by e-mail of these deadlines when shipping their order. Likewise, MITA FDG undertakes to inform the Customer of any delay in delivery that may occur and of which it is aware.

If it turns out that the product ordered is not in stock and/or the Customer orders it as a “pre-order” or “restock”, in the event that the product availability dates are not mentioned on the Website, it will take 3 (three) weeks for the manufacture of the product and one week for delivery.

7.3 Delivery times for products subject to CITES

Products subject to CITES (the Convention on International Trade in Endangered Species of Wild Fauna and Flora), will be subject to delivery conditions different from those indicated in Article 7.2. Among these products are those which include in their composition one or more exotic leathers and in particular crocodile, alligator, caiman, python, lizard, shagreen, ostrich.

MITA FDG does not deliver orders containing exotic leathers outside the European Union. Any order placed by the customer will be canceled by us – even after validation – if the delivery must be made outside the European Union. 

MITA FDG reserves the right to refuse any delivery and cancel any order – even after validating it – if it appears that the product ordered by the Customer must be delivered to a country and / or state prohibiting the marketing of exotic leathers subject to CITES regulations.

7.4 Deliveries abroad

Any order intended to be delivered outside France will be considered as an import by the Customer. Any product ordered and intended for delivery outside the European Union has an invoicing price including only the French VAT in force on the date of the order. Thus, the price of the product ordered does not include any customs and/or import duties, local and/or state taxes that may be payable. MITA FDG declines any responsibility for the payment of these taxes which are entirely chargeable and under the responsibility of the Customer in terms of declarations and/or payments to the authorities and/or competent bodies.

In case the Customer refuses receipt of delivery for any reason other than visibly damaged, torn, opened or repaired parcel, MITA FDG reserves the right to re-invoice the delivery and return costs and/or taxes, import and/or customs fees for returning products to France. Thus, all these costs will be deducted from the reimbursement of the order.

7.5 Delivery errors

The Customer must absolutely check the package and the products on delivery.

If the Customer finds a non-conformity during delivery (the package is damaged, torn, deteriorated, opened or repaired), she/he must refuse the package and note a reservation on the delivery slip (package refused because open or damaged) in order to benefit from the guarantee offered by the carrier. The Customer then has a period of 3 (three) days from the presentation of the package to inform the Customer Service of MITA FDG and to make reservations with the delivery company, by registered letter, on pain of foreclosure.

If, however, the Customer accepts the package, he must absolutely avoid signing the delivery slip indicating “subject to unpacking”, because this indication has no legal value and is not sufficient to establish that the damage existed at the time of the delivery. The Customer must make specific reservations and define the damage to the package when it is presented to her/him.

If the Customer accepts the delivery after noting the damage noted on the delivery slip or if the Customer has not been allowed to check its content and finds that the products are incomplete or degraded, she/he must inform the Customer Service of MITA FDG and make reservations with the delivery company, by registered letter, under penalty of foreclosure, within 3 (three) days of presentation of the package.

7.6 Ownership – Risks

Ownership of the products purchased is transferred to the Customer upon receipt of the products by the Customer. Consequently, the transfer of ownership of the products and the related risks of loss and deterioration is carried out, at the expense of the Customer, upon signature of the delivery slip by the Customer.

If MITA FDG is unable to ensure delivery due to error or omission of information in the delivery address, it will keep the package for a period of 3 (three) months from the date of the first presentation of the package. During this period, MITA FDG undertakes to contact the Customer using the contact details that the Customer will have provided when ordering (e-mail and/ or telephone).

After this period and without any response from the Customer, MITA FDG retains the ownership of the products ordered and the payment received when the order is placed. This constitutes acceptance by the Customer who no longer has any recourse to recover the amount paid and the unclaimed products.

8.1 Return and exchange terms and conditions

The Customer has the option of returning any defective product or product which does not correspond to her/his wishes within 14 (fourteen) days of receipt of the order. Any return request made outside this period will be refused.

MITA FDG does not accept exchange of products. The Customer who wants a product other than the one she/he ordered, will have to request a return of the product and place a new order.

In order to make a return, the Customer must contact the Customer Service of MITA FDG at the email address bonjour@alismita.com to obtain the return form and the delivery slip which must accompany the return of the order.

In the case of a return for reimbursement, the return costs as well as the insurance costs during the delivery are covered by MITA FDG. MITA FDG does not cover other costs relating to the return of the product such as the various taxes and customs charges which must be paid by the Customer or will be deducted from the total amount to be reimbursed.

Between receipt of the product by the Customer and receipt of the returned product by MITA FDG, the product is considered to be the property of the Customer and is entirely under her/his responsibility. The return of the product is confirmed upon receipt against signature by MITA FDG who undertakes to send the Customer a confirmation of receipt of the product by e-mail.

Returns for refund will only be accepted by MITA FDG if the following conditions are met:

  1. The return process described in the general conditions of sale has been applied correctly.
  2. Our Quality & Compliance Department confirms that all the components of the product are in conformity with the product sent, without damage or intervention of any kind;
  3. The products are returned in their original condition: new, in perfect condition, without having been worn. Thus, items returned incomplete, damaged or soiled will not be taken back. In particular, products showing scratches, even discreet ones, cannot be taken back.
  4. The products are returned in their original, complete and undamaged packaging (box, original certificate of authenticity, accessories, instructions for use or maintenance, etc.).
  5. The products are accompanied by their purchase invoice or a copy thereof and the return form duly completed and signed.

Any item that does not comply with the above conditions cannot be refunded or exchanged. The return will be refused and the item will be returned to the Customer who will have to pay the delivery and return costs as well as the related costs (taxes, customs fees etc.).

8.2 Terms of reimbursement

Any refund will be made by crediting the Customer’s credit card used to pay for the order. The refund will be made within a maximum period of 14 (fourteen) days after receipt of the order by MITA FDG.

8.3 Non-returnable and/or non-exchangeable products

Certain products offered by MITA FDG on the https://alismita.com website are neither returnable nor exchangeable. Thus, products delivered in France or in the rest of the world that have been the subject of a tax refund can not be refunded or exchanged.

Products that have been the subject, at the Customer’s request, of an additional or specific personalized modification (in particular the inscription of initials or any other customizable message on the product or one of the constituent elements of the product) cannot be reimbursed or exchanged.

The right of withdrawal is applicable only for orders that have been shipped to one of the member countries of the European Union (Germany, Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Spain, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Czech Republic, Romania, Slovakia, Slovenia, Sweden).

In accordance with the provisions of Article L. 221-18 of the Consumer Code, the Customer has a period of 14 (fourteen) working days from the date of receipt of her/his order, to return any product ordered and request thus the exchange or the refund without penalty, with the exception of the costs of return which remain with its load.

The right of withdrawal can be exercised online, using the withdrawal form available here or on request from Customer Service at the email address bonjour@alismita.com. The Customer must inform the Customer Service of MITA FDG who will provide her/him with the return slip to attach to the package.

The products must be returned in new condition in their original packaging, with the invoice, label, any accessories and the protective packaging. Return costs are the responsibility of the Customer. Subject to the aforementioned conditions, MITA FDG will refund to the Customer the amount of the order including the VAT and excluding the return costs. The customer’s bank account will be credited with said amount within 14 (fourteen) days of receipt of the products by MITA FDG.

The right of withdrawal can be exercised exclusively by the Customer. When, at the Customer’s request, the order has been shipped to a third party, the latter cannot return the product and can only benefits from the possibility of exchanging it once.

For any product having been the subject, at the request of the Customer, of a specific personalized modification (in particular inscription of the initials or any other personalized message on the product or one of the constituent elements of the product), the right of withdrawal is not applicable, which the Customer expressly acknowledges.

10.1 Compliance with current French legislation

The products offered by MITA FDG under the ALIS MITA brand comply with the French legislation in force at the time of posting on the Website. The Customer is responsible for informing herself/himself about the import procedures, the related duties and taxes that she/he will have to respect and pay to the authorities of the country and/or state to which the order is to be delivered. MITA FDG does not accept responsibility for any failure by the Customer to comply with the legislation of the country where the products are delivered.

10.2 Legal guarantee of conformity against hidden defects

MITA FDG guarantees the conformity of the products with the contract, allowing the Customer to make a request under the legal guarantee of conformity provided in Articles L. 217-4 of the Consumer Code or the guarantee against defaults of sold products within the meaning of articles 1641 of the Civil Code.

In the event of implementation of the legal guarantee of conformity, it is recalled that:

  • The Customer has a period of 2 (two) years from the delivery of the goods to act.
  • The Customer can choose between repairing or replacing the item, subject to the cost conditions provided for in Article L. 217-17 of the Consumer Code.
  • The Customer is exempt from providing proof of the existence of the lack of conformity of the goods during the 24 (twenty-four) months following delivery of the goods.

In addition, it is recalled that:

  • The Customer may decide to implement the guarantee against hidden defects of the item sold within the meaning of article 1641 of the Civil Code. In this case, the Customer can choose between canceling the sale or reducing the price in accordance with Article 1644 of the Civil Code.
  • The legal guarantee of conformity applies independently of the commercial guarantee indicated below.

MITA FDG extends the guarantee of conformity of products beyond 24 months and without time limit for any manufacturing defect under normal use. Manufacturing defects do not include scratches on leather and/or metalwork, change in color of leather and/or metalwork, tears in leather or other materials, breakage of jewelry and/or metalwork.

The content of the https://alismita.com website (technical documents, software, graphics, sound, visuals, drawings, photographs, texts, etc.) remains the property of MITA FDG, the sole holder of the intellectual property rights over this content. The Customer and/or User agrees not to make any use of this content; any total or partial reproduction of this content is strictly prohibited and is liable to constitute an offense of counterfeiting.

The responsibility of the company MITA FDG cannot be implemented if the non-performance or the delay in the performance of one of its obligations described in these general conditions of sale results from a case of force majeure. Any circumstances beyond the control of the parties preventing the performance under normal conditions of their obligations are considered grounds for exemption from the obligations of the parties and result in their suspension. The party invoking the circumstances referred to below must immediately notify the other party of their occurrence, as well as their disappearance.

In case of occurrence of an event of force majeure preventing the execution of these general conditions of sale, MITA FDG will inform the Customer within 15 (fifteen) days of the occurrence of this event, by e-mail.

In accordance with article 1148 of the Civil Code, will be considered as force majeure any irresistible facts or circumstances, external to the parties, unforeseeable, inevitable, independent of the will of the parties and which cannot be prevented by the latter, despite all the reasonably possible efforts. Expressly, are considered as force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of French courts and tribunals: total or partial strikes, civil disturbance, act of terrorism, war, blocking of means of transport or supplies, lockouts, pandemics, earthquakes, fires, floods, water damage, storms, floods, lightning, shutdown or malfunction of telecommunications networks.

The parties will come together to examine the impact of the event and agree on the conditions under which the performance of the contract will be continued. If the force majeure event lasts longer than three (3) months, these general conditions may be terminated by the injured party without compensation. Failure to pay by the Customer cannot be justified by a case of force majeure.

These general conditions are subject to the application of French law, to the exclusion of the provisions of the Vienna Convention. This is the case for the substantive rules as for the rules of form. In the event of a dispute or complaint, the Customer will first contact MITA FDG for an amicable solution. In the absence of an amicable resolution, the dispute will be brought before the Paris Commercial Court.

In accordance with article L. 612-1 of the Consumer Code, within one year of his written complaint, the Customer, subject to article L.152-2 of the Consumer Code, has the option of submitting a request for an amicable resolution by mediation, to:

15.1 Collection of personal data

The personal data collected on the https://alismita.com website are as follows:

  • Account opening

When creating the User’s account, MITA FDG collects their last name, first name, email address and date of birth.

  • Connection

When the User and/or the Customer connects to the Website, the Website records, in particular, his last name, first name, connection and usage data.

  • Profile

The use of the services provided on the Website makes it possible to complete a profile, which may include an address, a telephone number, an e-mail.

  • Payment

As part of the payment for the products offered on the Website, the financial data relating to the Customer’s credit card pass through a secure payment gateway using the https protocol and the 3D Secure 2 (3DS2) or Verified by Visa security devices that protect and encrypt her/his bank details. MITA FDG does not store or access the Customer’s credit card numbers.

Cookies are present in the context of the use of the Website. The User and/or the Customer has the option of deactivating cookies from the settings of his internet browser.

15.2 Data controller

The manager who collects personal data and implements data processing is MITA FDG, a simplified joint-stock company registered in the Paris Trade and Companies Register under number 838865558 and whose head office is located at 231 Rue Saint-Honoré, 75001 Paris. The User and/or the Customer can contact the data controller by mail at the above-mentioned head office address or by e-mail at bonjour@alismita.com.

15.3 Use of personal data

The personal data collected from Users and/or Customers are subject to computer processing and are intended to provide the services of the Website, their improvement and the maintenance of a secure environment. They are exclusively reserved for MITA FDG and are not and will never be sold. Their uses can be as follows:

  • access and use of the Website by the User and/or the Customer;
  • management of the operation and optimization of the Website;
  • organization of the conditions of use of payment services;
  • verification, identification and authentication of data transmitted by the User and/or the Customer;
  • implementation of User and Customer assistance;
  • personalization of services by displaying advertisements based on the User’s and/or Customer’s browsing history, according to their preferences;
  • prevention and detection of fraud, malware (malicious software) and management of security incidents;
  • management of any disputes with the User and/or the Customer;
  • sending of commercial and advertising information, according to the preferences of the User and/or the Customer.

15.4 Sharing personal data with a third party

Personal data may be shared with third party partner companies of MITA FDG, in the following cases:

  • when the Customer uses payment services, for the implementation of these services, the Website is in contact with third-party banking and financial companies with which it has entered into contracts;
  • when the User publishes information accessible to the public in the free comment areas of the Website;
  • when the Website uses the services of providers to provide assistance to Users and/or Customers, advertising and payment services. These service providers have limited access to User and Customer data as part of the performance of these services and have a contractual obligation to use them in accordance with the provisions of the applicable data protection regulations of a personal nature;
  • if required by law, the Website may transmit data to respond to claims against the Website and comply with administrative and legal procedures;
  • if the Website is involved in a merger, acquisition, transfer of assets or bankruptcy proceedings, it may be required to transfer or share all or part of its assets, including personal data. In this case, Users and Customers would be informed, before personal data is transferred to a third party.

15.5 Transfer of personal data

The personal data collected is not sold and is not subject to transfer abroad.

15.6 Implementation of User and Customer rights

In application of the regulations applicable to personal data, the User and/or the Customer has the following rights:

  • She/He can update or delete data concerning her/him by connecting to her/his account and configuring the parameters of this account.
  • She/He can delete her/his account, by writing to the email address bonjour@alismita.com. It should be noted that the information shared with other Users and/or Customers, such as the publication of notices on the Website, may remain visible to the public on the Website, even after the deletion of their account.
  • She/He can exercise her/his right of access, to know her/his personal data, by writing to the e-mail address bonjour@alismita.com. In this case, before the implementation of this right, MITA FDG may request proof of the identity of the User or the Customer in order to verify its accuracy.
  • If the personal data held by the Website are inaccurate, the User or the Customer may request the updating of the information, by writing to the e-mail address bonjour@alismita.com.
  • The User and/or the Customer may request the deletion of their personal data, in accordance with applicable data protection laws, by writing to the e-mail address bonjour@alismita.com. In case of no response or unsatisfactory response, the User can contact the supervisory authority in his country of residence. The competent authority in France is the CNIL (https://www.cnil.fr/). 

15.7 Evolution of this clause

MITA FDG reserves the right to make any changes to this personal data protection clause at any time. If a change is made to this personal data protection clause, MITA FDG undertakes to publish the new version on its website. MITA FDG will also notify Users and Customers of the modification by email, at least 15 (fifteen) days before the effective date. If the User or the Customer does not agree with the terms of the new wording of the personal data protection clause, he has the option of deleting his account.

16.1 Website management

MITA FDG implements the technical solutions at its disposal to allow access to the Website 24 hours a day, 7 days a week. MITA FDG may nevertheless at any time suspend, limit or interrupt access to the Website or to certain pages of this in order to update, modify its content or any other action deemed necessary for the proper functioning of the Site.

Connection and browsing on the Website constitute unreserved acceptance of these General Conditions of Use and Sale, whatever the technical means of access and the terminals used.

16.2 Responsibilities regarding the Website

MITA FDG is only responsible for the content that it has edited itself. MITA FDG is not responsible for:

  • in the event of technical, IT or website compatibility problems or failures with any hardware or software;
  • direct or indirect, material or immaterial, foreseeable or unforeseeable damage resulting from the use or difficulties in using the site or its services;
  • the intrinsic characteristics of the Internet, in particular those relating to the unreliability and lack of security of the information circulating therein;
  • illicit content or activities using its website without its having duly taken cognizance of it within the meaning of Law n ° 2004-575 of June 21, 2004 for confidence in the digital economy and Law n ° 2004- 801 of August 6, 2004 on the protection of individuals with regard to the processing of personal data.

Furthermore, the Website cannot guarantee the accuracy, completeness or timeliness of the information published there. The User and/or the Customer is responsible for:

  • the protection of its equipment and data;
  • the use she/he makes of the website or its services;
  • if she/he does not respect the letter or the spirit of these conditions of use and sale.

In the event of a computer incident observed, MITA FDG undertakes to inform the User/Customer of the seriousness of the facts within a maximum period of 2 (two) days after becoming aware of it. MITA FDG also undertakes to notify the competent French data processing authority, the CNIL.

Cookies are computer files stored on the Customer’s computer whose purpose is to quantify website traffic, to personalize the services offered and to record the Customer’s information and basket when logged in. These files record information about the User and/or the Customer such as: nickname, age, certain browsing habits but do not have access to his personal contact details. Once the Customer disconnects from the site, this information is stored for 30 (thirty) days before being permanently erased.

The use of cookies by MITA FDG on the https://alismita.com website is intended to better understand the research of the User and/or the Customer in order to improve the services offered and to better process his order. The customer can oppose the recording of cookies by configuring his internet browser (iOS, Internet Explorer, Chrome, Firefox). This causes a loss of information allowing the personalization of the services offered to him on the Site; the services offered to the User and/or the Customer on the Website are therefore no longer personalized.

The Website may contain hypertext links pointing to other websites over which MITA FDG does not exercise control. Despite the prior and regular checks carried out by MITA FDG, the Website declines all responsibility for the content that may be found on these sites.
